Die Rolle des palästinensischen Legislativrats im politischen System Palästinas (1996 – 2006)

Abstract

Die ersten allgemeinen und freien Parlaments- und Präsidentschaftswahlen der palästinensischen Autonomiebehörde (Palestinian National Authority, PNA), die als Teil der Friedensvereinbarungen Oslo I und Oslo II zwischen der Palästinensischen Befreiungsorganisation (Palestine Liberation Organization, PLO) und Israel am 20. Januar 1996 stattfanden, wurden als wesentlicher Bestandteil in der Errichtung eines demokratischen palästinensischen Staates betrachtet. Eine detaillierte Untersuchung der Zusammensetzung und Funktionsfähigkeit des palästinensischen Legislativrats (Palestinian Legislative Council, PLC) lässt erkennen, wie es im Zuge des Aufbaus des politischen Systems nach den Oslo-Vereinbarungen zum Scheitern demokratischer Ordnungsvorstellungen kam und ein personalisiertes autoritäres Herrschaftssystem etabliert und verfestigt wurde. Die Rolle des ersten Legislativrats (1996-2006) im politischen System Palästinas wird im Gesamtkontext von PLO und PNA untersucht, indem die internen Defizite der palästinensischen Staatsbildung und die systematische Marginalisierung des 1996 gewählten Legislativrats dargelegt werden. Insgesamt handelt es sich um eine empirische Analyse, die sich auf Fallbeispiele konzentriert und die internen Entwicklungen im Legislativrat und seine Kontrollfunktion bei unterschiedlichen Konfliktkonstellationen beleuchtet (z.B. in Bezug auf Regierungsbildung, Kontrolle über die Wirtschaftspolitik, insbesondere Wettbewerb, Korruption und die Investitionsverträge der PNA). Diese Fallbeispiele zeigen umfassend, inwieweit der Legislativrat seine Rolle als Kontrollorgan ausgeübt, welche Position er jeweils eingenommen hat, wie er seine Rolle nach und nach aufgegeben hat und wie der Machtkampf mit der Exekutiven, und insbesondere mit dem Präsidenten, immer zu Gunsten Letzterer entschieden wird. Die historisch-empirische Untersuchung der Rolle des Legislativrats im palästinensischen politischen System liefert auch konkrete Beispiele für die Herausbildung und Konsolidierung eines autoritären neopatrimonialen Herrschaftssystems.

The first general and free parliament and presidential elections of the Palestinian autonomic authority (Palestinian National Authority, PNA), as part of the peace agreements Oslo I and Oslo II between the Palestine Liberation Organization (PLO) and Israel on 20th January 1996, were regarded as a substantial component in the establishment of a democratic Palestinian state. A detailed investigation of the composition and operability of the Palestinian Legislative Council (PLC) shows how it came in the course of the structure of the political system after the Oslo Agreements to the failure of democratic organization and a personalized authoritarian rule system was established and solidified. The role of the first Legislative Council (1996-2006) in the political system of Palestine is examined in the total context by PLO and PNA, as the internal deficits of the Palestinian state formation and the systematic marginalization of the PLC elected 1996 are stated. Altogether it concerns an empirical analysis, which itself concentrates on case examples and which lights up internal developments in the Legislative Council and its control function at different conflict constellations (e.g. the function of PLC in connection with formation of government, control of economic politics, particularly competition, corruption and the investment agreements of PNA). These case examples show comprehensively to what extent the Legislative Council gave up its role as a control organ, which position it took in each case, and how it abandoned its role gradually so the struggle for power with the executive, and with the president, always is decided to favour of the latter. The historical-empirical investigation of the role of the Legislative Council in the Palestinian political system provides also concrete examples of the development and consolidation of an authoritarian and neopatrimonial rule system.
