Welche Verfassungsordnung für Europas 'erste Gemeinschaft'?

Abstract

Die Gestalt der Verfassungsordnung von Europas erster Gemeinschaft, der Europäischen Gemeinschaft für Kohle und Stahl (EGKS) ist nicht ohne eine detaillierte Analyse der Akteurspräferenzen bezüglich ihrer Kooperationsbereitschaft zu verstehen. Es werden die Absichten der beteiligten Staaten - Deutschland, Frankreich, Italien und die Benelux-Staaten - zur internationalen Kooperation untersucht, um eine Aussage darüber zu machen, welche Art von Institutionen diese Akteure jeweils bevorzugten. Der Beitrag versucht, eine Brücke zwischen instrumentell-rationalen sowie konstitutiv-normativen Erklärungsansätzen zur Institutionenbildung zu entwerfen.

The shape of the constitutional system of of Europe first community, the European community for coal and steel (ECCS) can not to be understood without a detailed analysis of the participant preferences concerning its willing to cooperate. The intentions of the states involved - Germany, France, Italy and the Benelux states - are examined for international co-operation, in order to make a predicate about it, these participants in each case preferred which type of institutions. The research paper tries to build a bridge between instrumental-rational and constitutive-normative explanation of institutional order.
