Implementing Climate Protection in the Legal System of China: International, National Legal Framework and the Case of Road Transportation

Abstract

This dissertation addresses the question of how to integrate the climate protection into the legal system of China with a focus on the regulation of road transportation .

The first part (Chapter A, B, and C) centers on the international legal framework of climate protection in terms of the commitments of developing countries in the international treaties. After reviewing the commitments of developing countries in the UNFCCC and the Kyoto Protocol, it analyses commitments of developing countries in the future international climate treaties.

The second part (Chapter D) is devoted to the general legal questions concerning the implementation of climate protection in the national legal system of China. The state’s duty to protect climate is firstly adressed, then concrete acts are briefly serveyed.

Finally in the third part (Chapter E and F) the special issues in regard to integrating climate protection in the regulation of road transportation are investigated. It involves not only technology-based regulations, but also non-technology-based regulations, such as the vehicle quota system, the vehicle taxes, the fuel tax etc.

Die vorliegende Arbeit beschäftigt sich mit der Integration des Klimaschutzes in den chinesischen Rechtsrahmen und fokussiert dabei speziell auf die Regulierung des Straßenverkehrs.

Der erste Teil (Kapitel A, B und C) befasst sich mit den Verpflichtungen der Entwicklungsländer im internationalen Rechtsrahmen des Klimaschutzes. Nach einer Einführung zu den Verpflichtungen der Entwicklungsländer nach der UNFCCC und dem Kyoto-Protokoll werden auch ihre zukünftigen Verpflichtungen im internationalen Rechtsrahmen erörtert. Der zweite Teil (Kapitel D) widmet sich dann den Grundlagen für eine nationale Gesetzgebung zum Klimaschutz. Hier geht es um die Verpflichtungen des Staates nach der Verfassung und konkrete Gesetze zum Klimaschutz. Im dritten Teil (Kapitel E und F) wird schließlich die spezielle Rechtsfrage des Klimaschutzes im Straßenverkehr diskutiert. Er bezieht nicht nur die technologiebasierte Regulierung ein, sondern auch nicht-technische Regelungsmöglichkeiten wie das Personenkraftwagen-Zertifikate-System, die Ölsteuer, PKW-Steuer usw.
