Abstract:
The contradictory character of theft and white collar crime is described against the background of a controversy over the validity of the labeling approach (particularly in the works of Fritz Sack). Theft, on the one hand, developed from the conflicts in society in which the bourgeoisie acquired power and established its legal system. White collar crime, on the other hand, is a result of the growing contradictions within that legal system and within its economic basis, especially since the turn of the twentieth Century. - For white collar crime the labeling approach leads’ to statements which are nominalistically „correct” or „true”, but which are historically non-analytical. Despite its critical intentions, the labeling approach must remain an integrationist concept.
