Rechtstheoretische Grundlagen der sozialistischen Kriminologie

Abstract

Die sozialistische Kriminologie muß sich systematisch den Prämissen der sozialistischen Staats- und Rechtstheorie unterwerfen und reproduziert so notwendig deren dialektische - oder ambivalente - Konstruktion: Nur in der problematischen Paarung eines ‘normativen’ mit einem ‘soziologischen’ Rechtsverständnis kann sie dem Paradigma von der sozialistischen ‘Übergangsgesellschaft’ und ihrer zwar strukturellen, aber aufhebbaren Disparität gerecht werden.

The socialist theory of criminology must be systematically subordinated to the premises of a theory of state and law. Hence it reproduces the ambivalence - or the dialectic - of a socialist unterstanding of law. It has to be based upon both the ‘normative’ and the ‘sociological’ understanding of law in a problematic manner if it wants to do justice to the paradigm of a socialist society in its ‘transitional’ character and its structural but alterable disparity.
